Abstract

This paper deals with the research of existential damage and its impact on the worker's life perspective. It is known that work is an essential condition for the development of the human species. Based on this premise, the historical evolutionary context of society with work and the formation of the basic principles of protection in labor relations were analyzed. Non-pecuniary damages were characterized, with an emphasis on existential damage, defining their origins and effects. Diseases considered to have great potential to cause existential damage were presented. The development of technology and its impact on labor relations were analyzed, as well as how the excessive use of these technologies implies the emergence of existential damage from their excessive use. An approach was made on the right to disconnection in line with the fundamental rights to leisure and rest, as well as the disrespect for such rights by the employer. In addition, legislation, case studies, and court decisions were analyzed as a result of practices that characterize existential damage. The article concludes with a reflection on the institute and suggestions for measures to be adopted for a more humanized labor relationship.
