Abstract

This study aims to analyze the obstacles to granting the Continuous Benefit Payment (BPC) to people with Attention Deficit Hyperactivity Disorder (ADHD) in Brazil. The objective of this study is to understand the legal and social implications of the lack of official recognition of ADHD as a disability, as well as the impacts of this gap on the lives of affected individuals. The methodology used in the work was a bibliographic review, of the Integrative Literature Review (ILR) type, based on scientific articles, national legislation and institutional data to support the discussion. The approach adopted includes the analysis of current legal standards, applicable public policies and the barriers faced by individuals with ADHD in seeking recognition of the benefit. The research indicates that the lack of specific regulation that recognizes ADHD as a disability for the purposes of accessing the BPC creates a scenario of legal uncertainty. This has led to judicialization. The judicialization of the benefit reflects the inefficiency of public policies in guaranteeing the rights of this population. Therefore, it is essential that the legal system and assistance policies are reformulated, ensuring greater security and equity for those who need the benefit.
