ENTRE OS DIREITOS HUMANOS E O NECROPODER: A COEXISTÊNCIA DA PROTEÇÃO E SUBALTERNIZAÇÃO DA PESSOA NEGRA NO BRASIL

Abstract

This work aims to understand how human rights, with their promise of universality, can coexist with practices and structures that perpetuate the subjugation of the black population in Brazil. The objective of the study is to envision to what extent necropower, as a pattern of sovereign power exercise, can be used to analyze the Brazilian state, revealing a paradox between dehumanization and protection. The methodology adopted was bibliographic research, conducted through a critical analysis of relevant theoretical materials already published, using the inductive method. The research sought to raise and organize the thought on necropolitics and human rights, with the aim of revealing the tensions between the universal promises of human rights and the concrete realities of the black population. The results obtained indicated that the practice of necropower in Brazil materializes mainly through police violence, the marginalization of urban spaces, and the precarious conditions of life for the black population. The conclusion of this research indicates that, in Brazil, there exists a sovereign power of death that acts by killing or letting the black person die, preventing the realization of the protection of their dignity. The state, while promoting laws and norms that guarantee rights, in practice perpetuates a system of racial oppression that redefines the black population as dispensable, deprived of full rights. This paradox between protective legislation and practices that exclude and kill reveals the structural flaws of the human rights system in Brazil.
