LEGITIMIDADE TECNOLOGICA OU VIOLAÇÃO DOS DIREITOS LABORAIS?

Abstract

Objective: to analyze the use of jurimetrics in lawsuits involving Uber and its impacts on the rights of platform workers, with the purpose of assessing the legitimacy of this legal technology and its relationship with the potential violation of labor rights, contributing to a deeper understanding of the legal, ethical and social implications of this emerging dynamic in the digital labor market. Methodology: This is a qualitative bibliographic review, based on the analysis of legal doctrines, academic articles, case law and reports on the application of jurimetrics in labor disputes. Results: The research identified that jurimetrics has been used to predict court decisions and influence Uber's procedural strategies, which may generate information asymmetries and inequality of conditions between the company and workers. In addition, there are indications that the technology may reinforce jurisprudential trends that disfavor the recognition of employment relationships. Limitations: The review is based exclusively on documentary sources, without including direct empirical analysis of the impacts of jurimetrics on individual lawsuits. The lack of specific data on Uber’s operations in different jurisdictions also limits the generalizability of the findings. Conclusion: The study concludes that the use of jurimetrics in Uber’s labor disputes raises concerns regarding procedural fairness and the protection of labor rights. Although technology has the potential to improve legal predictability, its indiscriminate use may reinforce structural inequalities, requiring greater transparency and regulation to ensure a fair balance between technological innovation and worker protection.
