THE IMPACT OF EC 103/2019 ON SPECIAL RETIREMENT: NEW CRITERIA AND CHALLENGES FOR GRANTING THE BENEFIT

This paper addresses the challenges of special retirement, highlighting the evolution of social protection and legislative changes in its requirements. The qualitative research, based on documentary analysis and bibliographic review, examines the impacts of these changes on the health and dignity of workers. The doctrinal criticisms focus on the minimum age requirement, which prolongs exposure to harmful agents, increasing risks to the worker's integrity, and on changes in the calculation of the benefit. The study emphasizes the need to broaden the debate on social protection in view of the possible precariousness of the benefit, concluding that it is essential to deepen the analysis of social security reforms considering the impact on the quality of life of workers, whose subsistence depends on these benefits.
