THE IMPACT OF THE PENSION REFORM ON THE ENFORCEMENT OF RIGHTS: AN ANALYSIS OF THE NEW RULES FOR SPECIAL RETIREMENT

Abstract: Constitutional Amendment No. 103/2019 introduced significant changes to Brazil's social security system, directly affecting special retirement benefits. This article analyzes how these changes impact the enforcement of workers' rights, with a focus on health protection and human dignity. Using a qualitative approach based on bibliographic and documentary research, it examines the new eligibility rules, the challenges faced by workers, and the social consequences of the imposed restrictions. The study highlights that the reform established stricter criteria for granting special retirement, such as a minimum age requirement, the elimination of time conversion from special to regular retirement, and a new benefit calculation method. It also assesses the compatibility of these new rules with the principles of human dignity and social protection.
