JUDICIALIZAÇÃO DO BENEFÍCIO DE PRESTAÇÃO CONTINUADA (BPC) PARA PESSOAS COM TRANSTORNO DO ESPECTRO AUTISTA (TEA): BARREIRAS ADMINISTRATIVAS E A NECESSIDADE DE INTEGRAÇÃO INTERSETORIAL

Abstract

This article examines the administrative barriers and judicialization of the Continuous Cash Benefit (BPC) for individuals with Autism Spectrum Disorder (ASD). The study highlights structural failures in the intersectoral coordination between health, social assistance, and welfare systems, leading to administrative exclusion and judicial overburden. Rigid income criteria often disregard families' extraordinary expenses, compounded by shortcomings in social and medical assessments. The findings reveal that judicialization addresses specific distortions but falls short in resolving systemic gaps. Proposed solutions include flexible eligibility criteria, enhanced intersectoral collaboration, and technical training to ensure equitable access to the BPC.
